Incoterms define the responsibilities of buyer and seller for delivery of goods under sales contracts. Incoterms aren't automatic; they are subject to negotiation and the successful buyer or seller is often the one who is best at negotiating the terms of sale. The terms were recently revised, trimming the terms down from thirteen to just eleven, tailored for the needs of users worldwide... Incoterms 2010 is the new authoritative text for determining how costs and risks are allocated to the parties in a transaction. These rules will come into effect on January 1, 2011. As the terms in the past, these Incoterms will be regularly incorporated into sales contracts worldwide and become part of the daily language of trade.
Incoterms 2010 sets forth the revised eleven terms of sale in a format easily readable and understood. The “mirror image” approach permits the reader to quickly compare its responsibilities, risks, and division of costs to that of the other party to the transaction. If you are negotiating, advising on, or implementing a sales contract you must understand the implications of the term of sale selected.
